1. Presentation of the Service
This document defines the terms and conditions under which Nemesys-Security (hereinafter ‘the Service Provider’) offers its customers digital cleaning services for social media profiles and/or proactive e-reputation monitoring, either online or through a subscription. The services are provided online, remotely, via a secure space or through direct contact.

Services include:
• Social profile audit.
• Algorithmic risk analysis.
• Manual or automated removal of posts identified as sensitive, subject to the client's authorisation.
• Continuous monitoring for monthly subscriptions.
2. Access and eligibility
The Client declares that they are of legal age or have the authorisation of their legal representative. Nemesys-Security reserves the right to refuse or interrupt a service at any time, particularly in the event of a breach of these T&Cs or suspicion of illegal content. All services are provided at the client's request and only on their own accounts.
No content will be deleted from a third-party account without explicit consent or without being the account holder. Services are reserved for personal, professional or institutional use within the legal framework.
For all orders:
• a form must be completed
• a quote will be provided
• payment is required before the service is performed.
3. Exclusion and prohibited content
Any illegal content is strictly prohibited.
The customer undertakes not to solicit Nemesys-Security for:
Any content related to an illegal act or statement will be automatically excluded from processing. This includes, but is not limited to :
• the glorification or promotion of terrorism
• threats, harassment or incitement to hatred
• paedophile offences or illegal sexual content
• revenge porn or the non-consensual dissemination of intimate content, harassment, blackmail
• scams, fraud, mass manipulation, identity theft
• any attempt to destroy evidence in an ongoing case, as well as any activity that is criminal or contrary to public order.
The Service Provider reserves the right to interrupt or refuse any service without refund if such content is detected or suspected, and to report it to the competent authorities if necessary. Nemesys-Security acts as a technical service provider. No service is provided without explicit instructions from the customer on their own accounts. Consequently, Nemesys-Security cannot be held liable in the event of false statements, concealment of illegal content or bad faith on the part of the customer.
Disclaimer:
Nemesys-Security cannot be held liable if a customer solicits our services while deliberately concealing the illegal nature of their content. In the event of detection of suspicious or illegal content, Nemesys-Security :
• immediately terminates the service concerned without refund
• archives the evidence
• and reports the incident to the competent authorities of the country concerned (see Article 7).
4. Pricing
Prices are defined according to the package chosen :
• Displayed including VAT according to the package chosen
• Options and supplements (volume, urgency, etc.) to be quoted
• Prices subject to change at any time (non-retroactive)
5. Payment
Payments are due at the time of ordering via the following methods: credit card, bank transfer, or other electronic means.
6. Turnaround times
• Services are provided within the timeframes indicated according to the package chosen (standard, fast, urgent).
• Additional time may be required in the event of complex analysis or specific requests.
7. Confidentiality
All data processed as part of our services is confidential. No personal information will be sold or shared, except in the event of a legal or judicial obligation. Compliance with the GDPR (EU) and the nLPD (CH).10. Reporting to the competent authorities
In the event of detection of potentially illegal content:
Nemesys-Security will contact, depending on the nationality or residence of the customer :
• In Switzerland: the Federal Office of Police (fedpol).
• In France: the Pharos platform (www.internet-signalement.gouv.fr).
• In the USA: the FBI (Internet Crime Complaint Centre – www.ic3.gov).
A time-stamped report of the incriminating data is kept for evidentiary purposes. The customer is informed that any content that constitutes a serious offence may be forwarded to the authorities without prior notice.
8. Limitation of liability
Nemesys-Security does not guarantee the complete deletion of all digital traces (particularly on third-party servers or in web archives). Nemesys-Security is not responsible for any professional, personal or legal consequences related to the existence of digital content outside our scope of intervention.
9. Applicable law & competent courts
This contract is governed by Swiss law. In the event of a dispute :
• Competent court: Commercial Court of the Canton of Vaud.
• In the case of international services, local laws may apply subsidiarily.
10. Archiving & digital evidence
Communications between Nemesys-Security and the customer may be archived for evidence purposes (emails, order logs, analysis reports). Nemesys-Security reserves the right to retain any information that may be useful for evidence purposes or in the event of a dispute.
By ordering a service, the customer acknowledges that they have read, understood and accepted these General Terms and Conditions of Sale.

5. Retention period

• For as long as the order is active
• For up to 12 months after the end of the service, unless early deletion is requested
• For up to 5 years for accounting or legal obligations

• Access restricted to authorised persons only
• Encryption of analysis files (if sensitive)

1. Nature of Our Services
Nemesys provides digital consulting and reputation cleaning services, often tailor-made and à la carte. These services include personalised assessments, audits, actions and manual or automated interventions at the customer's request.
Due to this intangible and personalised nature, our services are neither exchangeable nor refundable once they have commenced.
2. Right of withdrawal (private customers – EU zone)
In accordance with European Directive 2011/83/EU :
• The customer has a 14-day right of withdrawal as long as the service has not commenced.
• By expressly agreeing to the immediate performance of the service, the customer waives this right.
Example : if you order an immediate audit or clean-up, you will not be able to request a refund once the work has started.
3. Exceptional cases of refund
Partial refunds may be considered in the following cases:
• Billing error or double payment
• Purchase not finalised but debited
• Service not delivered on time and no return of the support within 7 days

4. Liability
Nemesys cannot be held liable for a result that does not meet the customer's expectations if :
• The customer has failed to provide the information necessary for the analysis
• The customer has refused the removal recommendations
• The targeted content is technically impossible to remove (e.g. reposts, archives, third-party servers)
• Anti-abuse clause : Any attempt to fraudulently use the services, abusive litigation or identity theft will result in immediate suspension of the account without refund.

• If such content is detected, Nemesys-Security reserves the right to refuse service and report it to the relevant authorities.
